I'm a Private Investigator & had a client from whom police seized a little over a grand when the client was arrested. When booked into jail the document which must be filed in order to get the money back during civil asset forfeiture proceedings was taken from her and placed on her property. Most of the cash had been withdrawn from the bank ATM the day before her arrest. She signed a request/release seeking a copy of her most recent statement to be given to her attorney/investigator. The release is in a format acceptable to all other financial institutions and for medical/psychiatric records. Bank of America insisted that their customer/my client execute the release in front of a Notary. This was impossible given the court deadline. A supoena was served on the bank manager ordering the manager to appear in court with the requested statement. Despite four days notice B of A legal department called after office hours the evening before the hearing to say they needed at least another week to try and obtain the records. The bank manager failed to appear in court as ordered, but since the client entered a guilty plea an arrest of the manager for contempt was not ordered. In the meantime, a little more than a week later, B of A legal called to say that despite the client's full name, mailing address, date of birth, social security number and the number on her ATM card, they were unable to connect all that information to her checking account. My opinion, after 36 plus years in law enforcement and 14 years as a Private Investigator is that B of A is either totally incompetent or a pack of liars. What a lack of concern for their client that they could not produce the client's statement which would show a large direct deposit and prove that the money seized was not income from [petty] drug sales. I had no dog in this race but I am cancelling my relationship with Bank of America because I do not do business with any company who is either incompetent or treats customers in the manner described. For the record, I think persons convicted of drug possession or sales should be punished under the law. But confiscation of personal property without due process when the party is unable to appear in court in a civil proceeding because they are serving a sentence is... well you think about it.
